These Terms of Service ("Terms") cover your use of Wayfolio, including the website at wayfolio.blog, the dashboard, and every blog hosted on a wayfolio.blog subdomain or a custom domain connected to Wayfolio (together, the "Service"). Wayfolio is operated by Seth Phat, an individual trading as Wayfolio ("Wayfolio", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Your account
- You must be at least 16 years old, or the minimum age of digital consent where you live if that is higher.
- Give us accurate information when you sign up, and keep your email address up to date so we can reach you.
- Keep your password safe. You are responsible for everything that happens under your account. Tell us right away at [email protected] if you think someone else has accessed it.
- One person per account. You may not sell, transfer or share your account.
2. Your blog and your content
You own what you publish on Wayfolio: your travel logs, blog posts, pages, photos and other content ("Your Content"). We don't claim ownership of it.
To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and deliver Your Content, only as needed to operate, secure and improve your blog and the Service. This license ends when you delete the content or your account, apart from copies kept for a short time in backups.
Published content is public. Anyone on the internet can read it, and search engines may index it. You are responsible for Your Content and confirm that you have the rights to publish it, including the photos you upload and anything that shows other people.
3. Acceptable use
You agree not to use the Service to publish, share or do any of the following:
- Anything illegal, or anything that promotes illegal activity.
- Content that infringes someone else's copyright, trademark, privacy or other rights.
- Harassment, threats, hate speech, or content that promotes violence or discrimination.
- Sexually explicit content, or any content that sexualizes minors.
- Spam, phishing, scams, malware, or misleading content that pretends to be someone else.
- Attempts to break, overload, probe or get around the security or limits of the Service.
- Scraping or reselling the Service, or using it to host files for use outside your blog.
If content breaks these rules, we may remove it, unpublish your blog, or suspend or close your account. Where reasonable, we will tell you first and give you a chance to fix the problem.
4. Plans and payment
Wayfolio has a Free plan and a paid Pro plan. The features and limits of each plan are listed on our Pricing page. The Pro plan costs US$14.99 per month, plus any applicable taxes.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries about payments and handles returns. When you buy Pro, you also agree to Paddle's Buyer Terms.
- Pro renews automatically every month until you cancel. Paddle charges your payment method at the start of each billing period.
- You can cancel at any time from Settings → Billing in your dashboard. Cancelling stops future renewals, and you keep Pro until the end of the period you have already paid for.
- If we change the price of Pro, we will email you at least 30 days before the new price applies to your subscription. You can cancel before then if you don't want to continue.
- Refunds are covered by our Refund Policy.
5. When Pro ends
If your Pro subscription ends, your account moves to the Free plan. Content you already published stays published, but Free plan limits apply to anything new. For example, you won't be able to publish more posts once you are over the Free limit. Pro-only features stop working. A custom domain stops pointing to your blog, and your blog goes back to the default theme and accent colors.
6. Custom domains
Pro accounts can connect a domain they own. You are responsible for registering and renewing your domain and for setting up its DNS records. We are not responsible for downtime caused by your domain registrar or DNS settings.
7. Closing your account
You can delete your account at any time from Settings → Account. Deleting your account permanently removes your blog, your content and your uploaded files, and it can't be undone. If you have an active Pro subscription, cancel it first so you aren't charged again.
We may suspend or close accounts that break these Terms, that put the Service or other people at risk, or that we are required to close by law.
8. Changes to the Service
We are always improving Wayfolio and may add, change or remove features. If we make a change that significantly reduces what Pro includes, we will tell you in advance. If we ever shut down the Service, we will give you at least 30 days' notice so you can export your content, and we will refund any prepaid, unused part of your subscription.
9. Disclaimers
We work hard to keep Wayfolio reliable and your content safe. However, the Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise that the Service will be uninterrupted or error-free. Please keep your own copies of content that matters to you.
10. Limitation of liability
To the extent the law allows, Wayfolio is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing.
Nothing in these Terms limits liability that can't be limited by law, or takes away rights you have as a consumer under the law where you live.
11. Changes to these Terms
We may update these Terms from time to time. If a change is significant, we will tell you by email or in the dashboard before it takes effect. If you keep using the Service after the change, you accept the new Terms.
